FAQ’s
Q: What is a bail bond?
A: A bail bond is a contract guaranteeing the arrestee (your friend/family member) will go to court, to answer the charges that lead to their arrest, each and every time they are ordered to do so by the court.
Q: I’ve heard that I can post Cash Bail, is that right?
A: Sure, although you must give the jail/court the full amount of the bail which they will hold for the time that your friend/family member’s case continues. (This can be for as little as a few weeks or more than a year or two. Depending on the seriousness of the charges for which they’ve been arrested.) In certain instances it may not be the right choice for your friend/family member to post cash bail because of the charge. You may want to consult with your attorney or just call us and we will explain the options and what is best in your situation.
Q: I don’t want to tie up my cash, what can Chickie’s Bail Bonds do to help?
A: On those occasions when our clients indicate that full payment of the premium due, will create an extreme financial hardship, Chickie’s Bail Bonds will agree to a payment plan option at no interest, taking into consideration the indemnitor’s ability to pay.
Q: I can’t leave work to meet with a bail bond agent; or I’m too busy to go to a bail agent’s office what can I do?
A: We will come to you, no matter where you are or when you have time to meet with us. We make the process easy and less stressful!
Q: If I pay the 10% is that all I have to do?
A: Paying the ‘premium” is one step, but the bail agent needs someone to co-sign or “collateralize” the bond. This means a guarantor that assures the bail agent that the “arrestee” (your friend/family member) will go to court each and every time the court orders their appearance, because if the arrestee doesn’t go to court the co-signor will have to pay the full amount of the bail to the bail agent who then has to pay the court. This collateral must have a value of at least the amount of the bond, so usually the bail agent will need a ‘lien’ on the property, normally called a deed of trust.
(3) A lien on real property (a home or office) or something else of value that can be pledged to guarantee the contract.
Q: Okay, so we pay for the bond and sign the collateral to Chickie’s Bail Bonds. What happens next?
A: The co-signor (the contract guarantor) will receive a receipt for their collateral and a receipt for the bond transaction, indicating the premium amount paid and the first court date assigned for your friend/family member. The bail agent takes the actual bail bond to the jail where your friend/family member is being held and ‘posts’ the bond. The jail then completes the processing of the bond and your friend/family member is released from their custody… The arrestee must then call Chickie’s Bail Bonds for a follow-up interview. And they must go to court at the date, time and location on indicated on the premium receipt.
Q: Do we need to hire an attorney?
A: It is always a good idea to have the arrestee represented by an attorney and if you cannot afford an attorney a “Public Defender” will be appointed.
Q: What happens when the court case is over?
A: The arrestee should call Chickie’s Bail Bonds telling them the case is over. Chickie’s Bail Bonds will confirm their release from the bail bond contract. Chickie’s Bail Bonds will close the file and return the collateral pledged.
